TERMS AND CONDITIONS OF

SALE

The following terms and conditions shall govern this transaction:

1)         It is a term of this contract that the purchaser shall pay all sums due to Interior Design and Property Solutions Ltd (IDPS) on the due date, this date being the date the goods are ready for collection / fitting and if they fail to do so Interior Design and Property Solutions Ltd (IDPS)

2)         may:

a)suspend delivery under any or all contracts with the purchaser while purchaser is in arrears;

and / or                             b)give notice in writing that if any such sum or sums be not paid in 14 days any or all such contracts may be cancelled.

c) If the purchaser intends to pay outstanding monies to Interior Design and Property Solutions Ltd (IDPS) after 14 days following the date of completion, an additional charge of 4% will be added.

The deposit paid by the purchaser is to cover Interior Design and Property Solutions Ltd (IDPS) expenses in ordering materials and is non-returnable in all circumstances unless materials are uncut and fit for re-sale. Payment must be made for the goods by the purchaser before or on delivery of goods, less deposit paid on placing the order. Receipt of  of Deposit is taken as acceptance of Terms and Conditions by the client.

If Interior Design and Property Solutions Ltd (IDPS) reasonably believes the purchaser to be insolvent, deliveries may be suspended until special terms of payment are agreed. Failing payment, Sue Scammell Curtains & Interiors shall be entitled to recover the goods and / or claim damages.

2)           All quotations are made and orders accepted subject to availability of materials. If ordered material is not available Interior Design and Property Solutions Ltd (IDPS) will endeavour to supply suitable alternative goods, which will be accepted by the purchaser unless expressly rejected within 14 days of supply of sample material.

3)           Liability is not accepted for any direct or indirect loss arising from non-delivery, or delays in delivery of any goods caused by war, strikes, lock-outs, fire, floods, explosions, accident, government restrictions or any cause whatsoever beyond Interior Design and Property Solutions Ltd (IDPS) control.

4)           No complaint as to the manufacture or fitting of the goods supplied can be considered unless made within 3 days of receipt of the goods.

5)           Whilst every effort will be made by Interior Design and Property Solutions Ltd (IDPS) to supply material substantially in accordance with true quality of the sample submitted, this cannot be guaranteed and the purchaser shall not be entitled to cancel this contract or claim damages or compensation as a result of minor variations from sample.

6)           Minor variations in colour and pattern from samples shown must be accepted by the purchaser.

7)           Patterns on materials are matched whenever possible unless instructions not to match are clearly written on order form. The cost of wasted fabric resulting from pattern matching must be borne by the purchaser, any offcuts will be given to the purchaser, if requested, on deliverv of order.

8)           Hem allowance will be a minimum of 20 cms. per width for all headings.

9)           The maximum liability of Interior Design and Property Solutions Ltd (IDPS) is to be the amount of the order. Claims for out-of-pocket expenses will not be entertained.

10)         A purchaser ordering curtains to sill length or level drop is advised to take into account the condition of their premises and other factors which are beyond Interior Design and Property Solutions Ltd (IDPS) control. Curtain fabric can vary in different conditions and therefore unusual conditions must be drawn to Interior Design and Property Solutions Ltd (IDPS) attention by the purchaser when placing the order This may enable

11)         Interior Design and Property Solutions Ltd (IDPS) to make allowances for some conditions, at the purchaser's cost, including strong sunlight, damp or excessive heat.

12)Prices quoted overleaf do not include fitting and hanging unless clearly stated. This service is available at an additional cost. Any variation to written agreement will be subject to further quotation.

13)     All orders are subject to a tolerence of 1 cm.

14)     Where the purchaser deals with Interior Design and Property Solutions Ltd (IDPS) as a consumer under the Unfair Contract Terms Act 1977, the purchaser's statutory rights will be honoured and in particular, clause 9 of these terms shall not apply.

15)     Where fabrics are supplied by the customer, liability is not accepted for suitability for end use and it will be assumed that these fabrics have been checked in all respects (e.g. quantity, shade variation, defects in manufacture).

PLEASE NOTE: Dry cleaning of large and fixed lined curtains is recommended in order to minimise shrinkage and to help maintain the handle and finish of the fabric.

PLEASE NOTE: The purchaser is advised to ensure all areas of walls & Ceilings where curtain fitments are to be mounted are structurally sound & suitable for the purpose intended. Whilst every effort for a secure fixing will be made, Interior Design and Property Solutions Ltd (IDPS) will not be liable for unsound plaster, brickwork etc.
